Terms of Use

1. Purpose

These Terms of Use (hereinafter "ToU") define the terms and conditions for accessing and using the Hikoo platform, accessible at www.tryhikoo.com and app.tryhikoo.com (hereinafter "the Service"), published by Hikoo SAS.

Registration and use of the Service imply full and unreserved acceptance of these ToU. If you do not accept these terms, you must not use the Service.

2. Definitions

• "User": any natural or legal person who accesses the Service and/or creates an account.
• "Service": all features offered by the Hikoo platform, including AI visibility analysis, GEO audits, citation tracking, competitive analysis and content recommendations.
• "Account": the User's personal space created during registration, accessible through their credentials.
• "Content": all information, data, texts, analyses and results generated by or through the Service.

3. Registration and User Account

3.1. Account Creation

Access to the Service requires creating an account. Registration can be done via email and password or through Google OAuth 2.0. The User agrees to provide accurate, complete and up-to-date information.

3.2. Account Security

The User is responsible for the confidentiality of their login credentials and all activity under their Account. contact@tryhikoo.com

3.3. Capacity

The Service is reserved for individuals aged at least 16 and for duly constituted legal entities.

4. Service Description

Hikoo is an AI visibility optimization platform (Generative Engine Optimization - GEO). The Service allows users to:

• Analyze their website visibility in AI-generated responses (ChatGPT, Google Gemini, Claude, Perplexity, Copilot, Grok, Mistral)
• Perform GEO content audits with performance scores
• Track brand citations and mentions by AI
• Analyze competition in AI responses
• Receive content optimization recommendations
• Generate llms.txt files

Available features depend on the subscribed plan (Lite, Growth, Scale or Custom). Hikoo reserves the right to evolve the Service.

5. User Obligations

The User agrees to:

• Use the Service in accordance with its intended purpose and these ToU
• Not use the Service for illegal, fraudulent purposes or purposes that infringe on the rights of third parties
• Not attempt to circumvent technical security or access limitation measures
• Not engage in scraping, reverse engineering or automated data extraction from the Service
• Not use the Service for spam, phishing or distribution of malicious content
• Respect usage limits associated with their subscription plan
• Provide accurate information during registration and billing

Any breach may result in immediate suspension or termination of the Account, without prejudice to any damages.

6. Intellectual Property

6.1. Hikoo's Property

The Service, its architecture, source code, algorithms and graphical interface are the exclusive property of Hikoo SAS and are protected by intellectual property laws.

The User is granted a personal, non-exclusive, non-transferable right to use the Service, limited to the duration of their subscription.

6.2. User Content

The User retains all intellectual property rights over the data and content they provide to the Service. The User grants Hikoo a non-exclusive, worldwide license limited to the contract duration to process this data solely for Service provision.

6.3. Generated Results

Analyses, reports, scores and recommendations generated by the Service are results produced by Hikoo. The User may use them within their professional activity but may not resell or redistribute them as a standalone service.

7. Availability and Maintenance

Hikoo strives to ensure 24/7 Service availability. However, Hikoo does not guarantee uninterrupted availability and reserves the right to temporarily suspend access for maintenance or updates.

8. Liability

8.1. Hikoo's Liability

The Service is provided "as is". Hikoo does not guarantee the accuracy, completeness or relevance of analysis results, which are partly generated by artificial intelligence technologies.

Hikoo shall not be held liable for indirect damages. Hikoo's total liability is limited to the amounts paid by the User in the preceding 12 months.

8.2. User's Liability

The User is solely responsible for their use of the Service and the results obtained. It is their responsibility to verify the relevance of recommendations before applying them.

9. Personal Data

The processing of personal data is described in our Privacy Policy.

10. Modification of ToU

Hikoo reserves the right to modify these ToU at any time. The User will be informed of any substantial modification by email or notification. Continued use of the Service after notification constitutes acceptance of the new ToU.

11. Termination

The User may terminate their Account at any time. Financial conditions are detailed in our Terms of Sale.

Hikoo may suspend or terminate the Account in case of breach of these ToU, after a 15-day formal notice, except in case of serious breach justifying immediate termination.

Upon termination, the User may request data export before deletion by contacting contact@tryhikoo.com.

12. Applicable Law and Disputes

These ToU are governed by French law. In the event of a dispute, the parties agree to seek an amicable solution before any legal action.

In accordance with Article L.612-1 of the French Consumer Code, consumers may use the European dispute resolution platform: https://ec.europa.eu/consumers/odr.

Failing amicable resolution, disputes shall be submitted to the exclusive jurisdiction of the courts of Hikoo SAS's registered office, unless mandatory consumer law provides otherwise.
